Delaware limits police agreements on immigration

Delaware law enforcement agencies cannot enter or renew agreements to use federal immigration powers or detain people for civil immigration violations. The ban also covers agreements to hold people in federal immigration custody for immigration law violations. Agencies cannot make agreements to share identifying information about nationality, citizenship, or immigration status unless a valid court warrant or federal law requires disclosure. Covered agencies include state, local, and campus police, probation and parole offices, and other listed enforcement offices. Local governments, law enforcement agencies, and state agencies with existing immigration enforcement agreements had to invoke termination terms before July 1, 2025. The law does not prohibit other public safety work with the federal government.
