Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 1 costs, 2 mixed.

Higher monthly assessments for manufactured-home landlords

Starting when the law took effect, the landlord share is credited at $1.50 per rented lot monthly, up from $0.50. Tenants and landlords each owe half of the monthly assessment. The Board sets the assessment and can change, remove, or restore it, but must notify landlords and tenants of adjustments. Any effect on tenants’ costs is not stated. These provisions end July 1, 2029.

More tenant money funds legal help

Starting when the law took effect, $1.50 of each tenant’s monthly lot assessment goes to the Delaware Manufactured Home Owner Attorney Fund. That is up from $0.50, leaving less of the tenant share for the relocation fund. The law does not state that tenants’ total assessments increase. This change ends July 1, 2029.

Relocation fund limits and renter payouts

The relocation fund has a $15 million cap, which its Board can change, remove, or restore under required voting rules. The fund expires July 1, 2029. If it ceases to exist, all its money must be paid out: half to tenants and half to landlords. Tenants receive equal shares only if they occupied their rented Delaware manufactured-home lots for the 12 months immediately before dissolution. Landlords must own rented lots at dissolution; their shares depend on how many lots they actually rented for at least 12 months beforehand.
