Military orders count in domestic violence reviews

Beginning January 1, 2026, Delaware courts must consider qualifying military protective orders when reviewing immediate danger from domestic violence. The order must be against the person responding to the court petition. It must follow a report that the petitioner, their minor child, or an infirm adult was a domestic violence victim. Qualifying orders come from commanders in the U.S. armed forces, Delaware National Guard, or another state’s National Guard. They are issued under federal law against someone under that officer’s command.
