Large data centers get separate electricity rates

Delaware-regulated electric utilities must create a separate service class and electricity rate schedule for large data-processing facilities. Covered facilities use or can use at least 20 megawatts and mainly provide services under 2022 industry classification code 518210. Rates must allocate costs to this class equally or proportionally, or assign costs directly to the facility. They must limit unfair cost shifts to other customers, including costs of meeting these facilities’ power needs. They must also limit risks to grid reliability in Delaware and the regional PJM power grid. The Public Service Commission must review customer costs and risks, fair contributions to grid efficiency and reliability, and renewable-energy and emissions goals. Its review also covers contracts for power sources supporting those goals and other public-interest conditions. The law takes effect upon enactment; utilities must apply within 180 days. It sets no rate amounts or direct change to household bills.
