The law creates a Delaware 250 commemorative plate for eligible vehicles owned by individuals or legal entities, including businesses. Eligible vehicles include private passenger vehicles and vehicles or trailers with a manufacturer's maximum weight rating of 26,000 pounds or less. Vehicles qualifying for the International Registration Plan, alone or as part of a vehicle combination, are excluded. The Division of Motor Vehicles must receive at least 200 applications before issuing plates. Plates keep the vehicle's current assigned numbers and letters. Delaware 250 submits the design for Division approval; it can replace “The First State” with “Delaware 250.” Designs cannot be entirely black and white, and the Division can reject designs that create public-safety enforcement problems. The Division can adopt rules to run the program.
Applicants pay a one-time $50 plate fee, including $15 for administration, in addition to any required annual registration fee. The $50 applies even to nonprofit members who are exempt from registration fees. Replacement plates carry a Division-set fee that must cover the plate's cost. Fee revenue pays for plate promotion and program administration, with remaining proceeds going to the Delaware 250 Fund. The State Treasurer holds that fund, and Delaware 250 decides how to spend it to support America's 250th anniversary celebration.
