Delaware combines thefts and raises penalties
Delaware allows related thefts by one person or a group to be combined into one charge. They must form a pattern of more than one act over time, regardless of how long. Their combined property value sets the offense level. Acts across Delaware jurisdictions can show that pattern, but only in a jurisdiction where an act occurred. For victims outside the protected groups below, theft below $1,500 is a class A misdemeanor; $1,500 or more is a class G felony. For victims aged 62 or older, adults who are impaired, or people with disabilities under state definitions, stricter rules apply. Theft below $1,500 is a class G felony; $1,500 or more is a class F felony. Regardless of victim status, theft above $50,000 but below $100,000 is a class D felony. Theft of $100,000 or more is a class B felony.
