AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO BREASTFEEDING.

Breastfeeding support with testing rules for inmates

The law takes effect one year after enactment. Delaware's Department of Correction must create a breastfeeding program with a contracted breastfeeding organization. It serves pregnant women, women after childbirth, and women producing breast milk in Department custody. Program rules must cover expressing and disposing of milk, same-day storage, and delivery to an infant or toddler. The woman chooses the person handling milk pickup or delivery, and the facility administrator must approve that person. The program must provide manual or electric pumps, storage bags, equipment sterilization, and a comfortable place for regular pumping. Pumping arrangements must follow national best practices. Participants must follow Department drug-testing policies, and failed screenings can prevent starting or continuing the program. All women producing breast milk in custody must receive prenatal vitamins. The program must also provide medically appropriate weaning care, nutrition information, and meal plans based on national best practices. The Department must post program information wherever facilities provide medical care and inform staff who work with pregnant or lactating women. It must publish annual counts of requests, participation, denials and reasons, milk-expression and transport use, failed-screening exclusions, and nutrition services. By January 1 each year, it must submit this report together with its medical-care report to the Governor, General Assembly, and Director and Librarian of the Division of Legislative Services.
