Cases involving alleged violations of Section 4764 in Newark by adults age 18 or older can start in Newark Alderman’s Court. That court shares authority over subsection (b) and (d) cases with the Court of Common Pleas, and subsection (c) cases with Justice of the Peace Court. For these adults, marijuana or other THC cases involving more than a personal-use quantity or public consumption can start in Alderman’s Court or the Court of Common Pleas. Newark civil violations for people under 21 involving personal-use amounts of marijuana or other THC can also start in Alderman’s Court. The law changes where cases can begin, not the underlying violations.
