Lower care costs for Delaware parents

Legally responsible adults generally owe no care or support costs for children committed to Delaware’s child services department or admitted to its services. Family Court can order payments only if they will not block proposed efforts to reunite the child with a parent. Any charges must reflect the adult’s ability to pay and follow Title 29, Section 7940. The department can collect amounts owed, including through a court action; collected fees go into the state’s General Fund. These protections cover liabilities incurred after the law’s effective date, but do not change earlier debts.
