Lawsuit protection for misconduct victims and witnesses

Delaware law protects victims and witnesses from civil lawsuits over qualifying statements about sexual assault, harassment, or discrimination. Covered incidents include sexual offenses, workplace sexual harassment, and housing discrimination involving sexual assault, harassment, or discrimination. Victims must have a reasonable basis to file a complaint, but do not need to file one. Witnesses qualify even without a reasonable basis to file a complaint. Protection excludes statements made knowing they are false or with reckless disregard for the truth. Defendants who win related lawsuits are entitled to attorney fees, costs, actual damages, punitive damages, and other legally allowed relief.
