Landlords cannot refuse to rent, charge more, cancel leases, or treat you differently because of protected traits like gender identity, source of income, or housing status. You can recover damages, including reasonable costs to find and move to substitute housing. Landlords may set aside units for seniors, but only as senior-only housing and without other discrimination. Housing that counts as comparable must be open to all without bias. Recorders cannot file property covenants that restrict sale or occupancy based on protected traits.
State and county officials cannot hire, promote, demote, or fire based on protected traits like gender identity or housing status. These rules cover the classified service and county positions. State apprenticeship and training programs must recruit, select, and train without discrimination. The State also takes affirmative action under its plan to give equal opportunity.
Contractors on state-financed public works must not discriminate in hiring, pay, or training based on protected traits, including housing status, sexual orientation, and gender identity. They must post required notices, include equal-opportunity language in ads, and take active steps to ensure fair opportunity. This adds compliance duties for contractors but strengthens job protections for workers on those projects.
The Delaware Veterans Memorial Cemetery offers burial without discrimination based on race, sex, national origin, or other protected traits. Eligible veterans and their families have equal access to burial rights.
Boards for medicine, chiropractic, podiatry, and funeral services cannot deny or limit licenses or certificates because of housing status or other protected traits. This applies to both applicants and current license holders.
More places count as public accommodations, including state and local agencies and public libraries. Civic parkland that is open for free must be open to everyone without discrimination. You cannot be kept off jury duty because of economic status or other protected traits. The Education Department may deny or revoke permits when an entity refuses to admit people based on protected traits.
Rideshare companies must have a written nondiscrimination policy and tell drivers about it. The policy covers gender identity and all protected traits under state law. Drivers must follow the policy and Delaware’s nondiscrimination laws when serving riders.
