AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE ESTABLISHMENT OF THE DELAWARE INDIGENOUS AFFAIRS COMMISSION.

New commission represents Delaware’s Indigenous communities

The law creates the Delaware Commission on Indigenous Affairs under the Secretary of State. It strengthens ties with Indigenous residents, including Lenape and Nanticoke people, and communication with sovereign Indigenous nations. It advises state leaders and works to improve health care, mental health, social services, housing, employment, and education. Its work also covers land acknowledgment, clean bays and fresh and salt water, native plants, invasive plants, and wetlands. It addresses protection of Indigenous burial sites and historic artifacts. The commission promotes Indigenous history through programs and events, partners with outside groups, and holds public hearings to improve community relationships. It has 9 members serving 3-year terms. At least 2 must be Lenape members chosen from a tribe-recommended panel; at least 2 must be Nanticoke members chosen the same way. The Governor appoints 5 Indigenous Delaware residents, who can represent Lenape, Nanticoke, or other Indigenous people. At least 1 member must have nonprofit or advocacy expertise or experience. Members are unpaid and serve at the Governor’s pleasure. They can serve multiple terms, but no more than 2 consecutive terms. Members elect a chair who manages meetings and records; the Secretary of State or a designee fills in during vacancies. A majority is needed to conduct business. The commission can form subcommittees, with nominees approved by majority vote, and take on duties assigned by state leaders. It must report significant activities annually to legislative leaders, with copies to all lawmakers, the Governor, legislative research officials, and Delaware Archives. The law does not establish direct household payments or new service eligibility.
