The law expands who must follow Delaware’s Equal Accommodations Law. It now covers sole proprietors, LLCs, trusts, government bodies, and other legal or commercial entities. A “place of public accommodation” includes places open to the public, all state and local agencies, public libraries, and entities paid by the State to do public work. It also includes people doing that work under agency control, and hotels and motels. It does not cover home sales or rentals, or tourist homes with fewer than 10 rental units.
The law sets when these definition changes start. If House Bill 36 passes both chambers by July 1, 2025 and is enacted, they start 1 day after House Bill 36 takes effect. If House Bill 36 has not passed both chambers by July 1, 2025, they start immediately. If House Bill 36 passes both chambers by July 1, 2025 but is not enacted, they start on November 1, 2025.
