Broader felony rules for prostitution businesses

Delaware expands the class E felony of promoting prostitution in the second degree. It covers knowingly advancing or profiting from prostitution by managing, controlling, running, advertising, or owning businesses involving two or more prostitutes. This includes businesses that use massage services as a cover for prostitution. Advancing or profiting from prostitution involving someone under 18 remains covered, without the two-person requirement. The law also updates sexual-offense definitions and sex-offender community notification rules to include specified prostitution offenses. Courts can assign specified offenders to Risk Assessment Tier II when they find that public safety will improve.
