Nurse anesthetists gain stronger insurance payment protections

The law applies to policies, contracts, or certificates issued, renewed, modified, altered, amended, or reissued after December 31, 2026. Delaware individual, group, state employee, and Medicaid plans must pay certified registered nurse anesthetists at least the physician rate for the same covered service. The service must fall within the nurse anesthetist’s licensed scope of practice. Health insurers cannot exclude these nurses as covered providers or deny benefits because they provided an eligible service. Plans can vary payments based on quality or performance, while keeping the base rate at least equal to physician rates. The law does not set household premiums or copayments.
