School board members face stricter residency rules

Delaware school board candidates and members must claim legal residence in, and physically live in, the district or area represented. Members lose eligibility when absent from the district for more than 75% of days in any consecutive year-long period during their term. Military deployment counts as being present. A district resident with good cause to believe a member no longer qualifies can ask Superior Court to declare the seat vacant. This court option applies when the board has not declared a vacancy.
