The law creates an 11-member task force to review Delaware’s impaired-driving laws and recommend changes. Members include lawmakers from both parties and officials from courts, prosecution, defense, corrections, probation, and substance-use services. Its first meeting must occur within 60 days after enactment, when members choose two co-chairs. It must study arrest and conviction rates, failed prosecutions, repeat offenses, and sentencing practices. It must consider stronger deterrents, including higher fines, longer jail terms, and required addiction treatment that plea deals cannot waive. It must also identify ways to detect drug-impaired driving and the costs of equipment and officer training. State agencies must answer information requests from the task force or its staff within 90 days. The Attorney General’s office provides staff and materials, and the findings and recommendations are due by January 1, 2026. The law requires a review; it does not itself raise penalties or require treatment.
