Clearer hearings and faster line-of-duty claims

For contested claims, the Insurance Commissioner holds a hearing. You may bring a lawyer. The Commissioner can take evidence, subpoena records and witnesses, and place people under oath. The office must keep a written or taped record and give written reasons for the decision. If no one contests the claim, the Commissioner can decide it on the papers.

Commissioner can set claim process rules

The Insurance Commissioner can issue rules for how to file, process, and decide claims, including hearing rules. These rules can change forms, timelines, or what proof you need.

State can challenge line-of-duty claims

The State Insurance Coverage Office can contest any line-of-duty death claim. The Insurance Commissioner must consider that office’s objections when deciding. This can make some claims take longer or be harder to win.
