Hospitals and surgery centers must use smoke evacuation

Hospitals and freestanding surgical centers in Delaware must use a smoke evacuation system during any surgery likely to create smoke. A smoke evacuation system captures and filters smoke at the source to protect patients and workers. Facilities must adopt and follow these policies by April 1, 2026. The Division of Health Care Quality enforces this rule under its existing authority. Facilities may need to buy and maintain this equipment.
