AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE DEPARTMENT OF FINANCE AND CRIMINAL BACKGROUND CHECKS.

New background checks for Delaware finance contractors

Delaware's Finance Secretary or designee can require background checks for current and prospective Department contractors. This applies when contractors need or may need access to Department systems, facilities, or data identified as requiring checks. Third parties are excluded from this contractor rule. Existing check requirements remain for current employees and people conditionally offered Department jobs. Checks require fingerprints and other needed information for Delaware and national criminal records searches through the State Bureau of Identification. Current employees and contractors must submit the required information within 30 days after receiving the Department's written request. The bureau sends the required results to the Secretary or designee. The Department can use these records, as allowed by law, to decide employment qualifications or continued access.
