Bill Overview

Analyzed Economic Effects

4 provisions identified: 0 benefits, 0 costs, 4 mixed.

Electronic bidding with protected paper options

Delaware agencies may require electronic bids or offer them alongside paper bids when they find electronic bidding useful. Bid requests must explain accepted methods and name the required electronic platform or provider. Agencies must accept paper submissions for covered purchases and public works costing less than $500,000 but above the small-purchase threshold. The Office of Management and Budget sets that lower threshold in its annual guidance. An email submission option must also be available.

Contractors can agree to award delays

Public works awards are generally due within 30 days after bid opening, or 60 days for school districts. Bid-compliance or bidder-responsibility issues allow up to five extra working days, with advance notice. The agency and chosen bidder may also agree to extend the award deadline. The law sets no maximum length for that agreed extension.

Online bid openings change public access

For electronic-only bidding, an agency representative and witness open bids immediately after the deadline, without a required public meeting. Agencies record bidder names, submission times and prices, and prepare a bid-results table. When both paper and electronic bids are accepted, openings must allow public attendance and publicly read or display required information. Proposal openings display offeror names and specified information online, while agencies protect confidential proposal contents. Agencies provide bid results in real time and post bid-results tables on their websites within two business days after award.

State contract notices move online

Government Support Services runs Delaware’s central system for procurement records and public contract postings. Other agency bidding systems need the Director’s written approval, must connect to the central system, and publish required information there. Posting required notices through the designated state system satisfies public-notice rules and replaces newspaper advertising. Public works ads run online for two consecutive weeks, unless the Section Director approves a shorter period. Ads must name the platform or provider when electronic bids are required.
