Limits immigration enforcement help at Delaware sites
Delaware police officers and constables need the Attorney General’s approval to help federal civil immigration enforcement at certain sites. These include child-serving entities, colleges, places of worship, and health-care facilities. Health-care sites include hospitals, long-term care facilities, nursing homes, home health care, adult day care, laboratories, and licensed providers’ offices. Written requests must arrive at least 72 hours before the activity. Requests must identify the agency, reason, dates, duration, purpose, records sought, potentially affected people, and how officers will help. The Attorney General must respond within 48 hours after receiving the request; no response means approval. These limits apply to state and local officers, not federal officers acting on their own. They do not cover cooperation on criminal cases or civil matters unrelated to immigration. The law does not create liability for agencies.
