Patients get more therapy without referrals

Delaware patients can receive physical therapy without a referral for up to 90 days, up from 30 days. After that, a physician must be consulted. Treatment can also follow a referral from, or consultation with, a licensed health practitioner authorized to prescribe for that condition. Existing safeguards remain: therapists must stay within their licensed scope. They must refer patients elsewhere when symptoms need care beyond their knowledge.

New license rules for therapy professionals

Delaware physical therapists and athletic trainers must renew licenses every two years, pay a fee, and confirm continuing-education compliance. The Division sets the renewal process, subject to Board rules. The Board can allow late renewal for up to one year, replacing the old five-year renewal window. Licenses can remain inactive for up to five years. Reactivation requires a request to the Division, a Division-set fee, and proof of continuing-education compliance. The law does not specify fee amounts. It removes the fixed January 1 expiration date, automatic-expiration language, separate inactive register, and standalone perjury penalty for false statements.
