Delaware patients gain coverage for biomarker tests

The law requires biomarker testing coverage in Delaware individual, group, state employee, and public assistance health plans. It applies to policies, contracts, or certificates issued, renewed, modified, altered, amended, or reissued after December 31, 2026. Biomarker tests check tissue, blood, or other samples for signs such as gene changes or protein levels. Covered tests must help diagnose, treat, manage, or monitor a disease or condition and have medical and scientific support. Evidence includes FDA-approved or cleared test uses, FDA-approved drug indications or label warnings, Medicare coverage decisions, or recognized clinical guidelines or consensus statements. Plans must limit care disruptions, including minimizing repeat biopsies or sample collection. Individual and group policies can keep deductibles, coinsurance, allowed-charge limits, and rules coordinating payments with other coverage. The mandate excludes accident-only, specified-disease, hospital indemnity, Medicare supplement, long-term care, disability income, and other limited-benefit policies.
