AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO STATE GOVERNMENT AND THE STATE EMPLOYEES’ PENSION PLAN.

New pension formula for Delaware lawmakers

Delaware lawmakers elected on or after February 28, 2025, have pensions calculated under the standard formula in § 5527(a)(1). Earlier electees keep a minimum pension based on their Assembly service years multiplied by the highest retired lawmaker payment rate. That rate equals a retired lawmaker’s monthly pension divided by their years of Assembly service. The standard formula’s details are not included here, so individual dollar changes are unknown. Those elected before January 1, 2012, qualify at age 60 with 5 service years, or age 55 with 10. Those elected on or after January 1, 2012, qualify at age 60 with 20 service years, or age 65 with 10. These rules cover ordinary service or disability pensions. Lawmaker pensions, eligible survivor pensions, and contributions use pay earned as an elected official, regardless of other credited service. Pensions earned through other credited service remain separate and follow the chapter’s other rules.
