Delaware storage rental agreements can be delivered and accepted electronically. Rental agreements include written or oral agreements governing storage use. Your last known address is the address in your latest rental agreement or a later written change-of-address notice. An address update must follow any requirements in your rental agreement.
You can become bound by a written Delaware storage agreement without signing it. This applies if you pay, rent, or use the space more than 30 days after the agreement is delivered.
After written notice of termination or nonrenewal, Delaware storage customers cannot continue using the facility except to remove property. Either party can deliver the notice in person, by email, or by verified mail. The notice must allow at least 14 days from delivery to remove all property. Owners can reasonably restrict removal access, including limiting it to normal business hours. Owners can dispose of property left after the deadline stated in the notice.
Delaware storage owners have a lien—a legal claim—on stored property for rent, labor, other charges, and qualifying preservation or sale expenses. It attaches when property arrives, if the written agreement says so, and outranks other claims except liens on qualifying titled vehicles. Every rental agreement must warn that a lien exists and that property can be sold after default. After the required notice period, sales must be advertised for two consecutive weeks in a county newspaper or qualifying website. Newspaper notices run once a week; advertising websites must be public, independent, and regularly advertise or conduct personal-property auctions or sales. Ads must identify the property, facility address, space number if any, each affected customer, and the sale's time, place, and method. One ad can cover multiple customers, but the sale cannot occur earlier than 30 days after the first publication. Sales can occur at the facility, a suitable nearby place, or a qualifying public auction or sales website. These sales are part of the storage business and require no license.
A Delaware storage owner can have your vehicle, trailer, or boat towed after 60 consecutive days of default. The owner must send the towing company's name, address, and phone number, plus the street address for reclaiming your property. The information must go to your last known address by verified mail or email. If an electronic receipt does not confirm email delivery, the owner must send the information by verified mail.
