Delaware renewable energy substations gain permit protections

Electrical substations on unincorporated land in Delaware counties require a conditional-use permit. Counties cannot deny that permit or directly related project infrastructure when the substation supports a proposed renewable energy project of at least 250 megawatts. The site must be in a heavy industrial district where substations are allowed as a conditional use. That district must already have had a substation rated at least 230 kilovolts as of August 8, 2023. Qualifying applications filed on or after August 8, 2023, and before enactment are deemed approved, including previously denied applications. Counties cannot change zoning or take other action to make previously filed applications fail the law’s requirements.
