Injured crash victims can undo early settlements
The Delaware law takes effect six months after enactment. It gives people injured in car accidents a limited right to undo injury settlements. For signed releases, you must have signed within 30 days of your injuries, without a lawyer’s help or guidance. You must also have had no related power of attorney or contract hiring a lawyer. You have 60 days after signing to undo the release. Without a signed release, the 60 days starts when you cash a settlement check or receive an electronic payment. You must send written notice and return any settlement check or money to the party released, its lawyer, or its insurer. Both must be sent no later than 10 days after the 60-day period ends. Releases signed within 30 days of the accident must include a clear, separate notice of this right on the release or settlement check. If neither document exists, the notice must be provided in writing.
