AN ACT TO AMEND TITLE 16 OF THE DELAWARE CODE RELATING TO LONG-TERM CARE FACILITIES.

More ownership transparency for long-term care

Delaware long-term care facilities must disclose all owners, their ownership shares, and people controlling non-publicly traded ownership entities or affiliates. Affiliates are people or entities that control another person or entity, are controlled by it, or share common control. The state must publish ownership information online; facilities must prominently post current information on their websites and in advertising and promotional materials. At least 60 days before an ownership transfer, incoming owners must give current residents or their authorized representatives the new owner's name. They must also disclose facilities they or affiliates owned, operated, or managed in any state or territory during the past year, plus enforcement actions during that year. Incoming owners must separately report to the state other licensed facilities they or affiliates owned in any state or Washington, DC, during the past year. Their state disclosure must also include past-year enforcement actions against facilities they or affiliates owned, operated, or managed in any jurisdiction. The state can delay or deny the incoming owner's license when submitted or verified information shows a pattern of serious violations or enforcement actions that raises concerns about following state and federal law.
