The law confirms that all Delaware municipalities can set separate tax rates for residential and nonresidential property. They must set these rates through a local law or ordinance. Every property within the same class must have the same tax rate. No separate charter amendment is needed. The law does not set rates or require different rates, so changes to homeowners’ bills depend on local decisions.
