Cooperatives can refuse supply to large users

The law applies to Delaware electric cooperatives while exempt from state utility regulation and operating a retail-competition plan. These cooperatives can decline electric supply service to customers whose projected monthly demand exceeds 50 megawatts during a 10-year ramp-up period. Commonly owned customers, including those owned by affiliated entities, on the same or adjoining parcels can count as one customer. Outside this large-user exception, cooperatives must still supply customers who lack supplier choices, choose no alternative, or whose supplier fails to deliver. Service follows the cooperative’s published rates and terms. The law sets no direct household price change.
