Delaware utilities face new electricity forecast oversight

Delaware’s Public Service Commission can review regulated electric utilities’ demand forecasts and set rules for this oversight. It can check whether planned projects are likely to move forward, including customers’ financial commitments. It can work with regional grid operator PJM and other states to prevent counting the same demand twice. Utilities must provide requested customer contracts that affect forecasts, and the Commission must protect confidential information. By May 1 each year, the Commission must report to lawmakers and post the report online. Reports must cover the prior year’s oversight work, findings, coordination, and recommended legal or rule changes. The law ends December 31, 2035, unless the General Assembly renews it.
