The law creates the Delaware Disaster Recovery Fund for residents and local governments, including when federal help is delayed or unavailable. Help can cover food, medical supplies and equipment, temporary rent, moving costs, modular housing, and emergency repairs. It also supports repairing or replacing occupied damaged homes and paying insurance gaps, including deductibles, with priority for safe, livable housing. Activation triggers include disaster damage reaching levels set in program guidelines, or local or county needs exceeding capacity with assistance requested. A governor's emergency declaration or activation request is another trigger; the emergency management director activates the Fund with council agreement. The emergency management and housing agencies lead recovery programs, and the Recovery Advisory Council can add or reassign lead agencies. The Fund accepts public and private money, which stays in the Fund rather than returning to the General Fund. Program managers set disaster-related application periods, track results, and report to lawmakers within 90 and 180 days after activation, then annually. The council must adopt bylaws within 90 days of Fund establishment, coordinate programs, and establish an appeals process.
Fund-supported repairs, restoration, rebuilding, or replacement of occupied damaged homes must include accessibility features and reasonable modifications. These features must help people with disabilities use the housing safely and meet applicable state and federal law. Program operations must also meet federal disability access requirements. Annual reports should include information on assistance to people with disabilities where practical.
The Fund can support infrastructure upgrades, disaster risk reduction, preparedness, and community resilience projects. It can also match federal or private grants, but must add to—not replace—other available local resources. The Recovery Advisory Council sets spending triggers, including dollar thresholds, and the minimum reserve kept for recovery. Any waiting-period trigger must last at least one year after activation when Fund money has not served its main recovery purposes. Prevention and preparedness spending cannot use up the whole Fund.
