Delaware counties, municipalities, and state agencies cannot sign agreements that block public disclosure about planned or actual large-scale data center development. The rule covers facilities mainly used to store, manage, process, or send digital data. They must use, or be able to use, at least 100 megawatts of power. The ban includes confidentiality clauses and other secrecy arrangements, and covers anyone acting for a county or municipality. Any agreement that violates the ban is void and cannot be enforced.
