Easier handgun purchases for constable agencies

Delaware exempts qualified constable agency representatives buying handguns for constables from applicable background-check and purchase-permit requirements. The representative must be a constable whose employer authorizes handgun purchases on behalf of its constables. Eligible constables must be commissioned under state law and licensed by the Delaware State Police to carry firearms. They must also have the Constable Board of Examiners’ approval to carry firearms during official duties. The State Bureau of Identification must issue purchase permits to qualified representatives who apply for them. Applications for handguns used by the employer’s constables during official duties are exempt from §1448D(f)(4) and subsection (h). A permit becomes void if its holder loses qualified status or becomes disqualified under applicable rules; the Director can also revoke it.
