New insurance rules for Delaware care facilities

The law takes effect 180 days after enactment. Delaware nursing facilities, assisted living facilities, and group homes for people with mental illness must carry liability insurance. General and professional liability coverage must each provide at least $1 million per claim and $3 million total, including abuse and molestation coverage. Facilities must show proof to get and keep state permission to provide health care, and at each renewal. Insurers must notify the state Department within 14 days when coverage lapses or is canceled. Facilities lose their licenses if they fail to maintain the required insurance limits.
