Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Stronger collection protections for medical debt patients

Medical creditors and medical debt collectors cannot seize patients' physical belongings to collect debts for health-care services. Anyone seeking to collect medical debt in court must identify their status in court filings. They must state whether they are a medical creditor, a medical debt collector, or neither, using Delaware's legal definitions. Missing or incorrect disclosures violate the law and are subject to all remedies available under the Medical Debt Protection Act.

Medical debt sellers face less liability

The law removes a rule holding large health-care facilities or medical creditors responsible for a debt buyer's or collector's actions. The removed rule covered medical debt sold under a contract described in Delaware Code § 2502J(4)a. Patients lose this specific basis for holding the seller responsible for the buyer's or collector's conduct.
