Bill Overview

Analyzed Economic Effects

2 provisions identified: 2 benefits, 0 costs, 0 mixed.

Electric customers get reliability cost limits

From 2026 through 2028, Delaware limits the reliability project costs electric distribution companies can recover through rates. Each company can recover no more than $125 million per year in capital costs to keep its system reliable. The Public Service Commission must approve greater spending, and only when emergency or extraordinary circumstances require it. The law does not show how much this changes a household’s electric bill.

Utility customers protected from unrelated spending

Delaware’s Public Service Commission must stop regulated utilities from using customer money to support activities outside regulated utility work. Utilities cannot recover lobbying costs, political spending, charitable gifts, or dues and contributions to groups that lobby on laws or regulatory decisions. This ban applies to base rates, added charges, and other customer charges. It also blocks unrelated advertising and public relations costs, including brand promotion, goodwill campaigns, and efforts to shape public opinion. Exceptions cover ads required or allowed by law or Commission rules or orders. They also cover ads about income-based services, special rates, pilot programs, energy saving, beneficial electrification, consumer education, outages, safety, emergencies, and jobs. The law sets no household savings amount.
