Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Ongoing criminal-history notices to employers

If enacted, the Department would have to write rules to use the Rap Back System so that later criminal-history information about a worker is provided to that worker’s current and future employers. The rules would cover who is subject to the system, what information is shared, how applicants and employers are notified, and an administrative review process. Employers could get timely updates about workers, while workers could face job impacts based on new criminal-history reports.

Three-year background check validity

If enacted, this legislation would make a criminal-history report obtained through Delaware’s Background Check Center valid for any prospective employer for three years from your last fingerprinting. The report must come from the BCC screening process. You could use that report when applying to another prospective employer during the three-year window instead of repeating fingerprinting and screening.
