Delaware sets water limits and warnings

The law takes effect 90 days after enactment and sets PFAS limits for Delaware public drinking water systems. Limits are 4.0 parts per trillion for PFOA and PFOS, and 10 for PFHxS, PFNA, and HFPO-DA (GenX). Mixtures containing two or more of PFHxS, PFNA, GenX, or PFBS have a Hazard Index limit of 1. This index adds each chemical’s measured level divided by its no-health-risk level. The Division of Public Health must maintain a user-friendly website showing available PFAS levels for every public water system. A prominent Office of Drinking Water homepage link must lead to the site, which must include or link to a limits chart. Missing results must have expected posting dates and be posted as soon as available. When monitoring finds levels above a limit, the Division must promptly notify the utility. The utility must promptly notify all affected Delaware residents by U.S. mail at the address receiving water. Notices must state the exceedance, give exact levels for each chemical above its limit, and include a Division brochure explaining PFAS and showing limits. The Department of Health and Social Services must implement and enforce these requirements; the Division can issue regulations.
