Advance directives use current Delaware law

Beginning September 30, 2025, Delaware reads any advance health-care directive under Delaware law in effect when it is used. This applies to directives made before, on, or after that date. Delaware does not use its "choice of law" rules to switch to another state's law. This gives patients, families, and providers a clear rule at the time of care.
