Delaware law guides advance health-care directives

Beginning September 30, 2025, Delaware law governs how advance health-care directives used in Delaware are interpreted. The law in effect when the directive is used applies, regardless of when the directive was created. This includes directives created before, on, or after September 30, 2025. Delaware’s rules for choosing another state’s law do not apply.
