Delaware law bans anyone from reporting medical debt to credit reporting agencies. Agencies cannot include medical debt in reports when they know, or should know, what it is. Covered debt is for medical services, products, or devices owed to providers whose main business is supplying them. Coverage includes current and paid bills. Ordinary credit-card balances are excluded; credit-card debt counts only when the card plan is solely for health care payments.
A medical debt sale avoids classification as an extraordinary collection action only with a binding written agreement made before sale. The agreement must bar the buyer or collector from extraordinary collection actions and bar the buyer from charging interest. It must also bar the buyer from sharing medical debt information with credit reporting agencies. It must allow return or recall when the creditor or buyer finds the patient eligible for financial assistance. Required procedures must limit combined payments and amounts owed to the buyer and creditor to the patient's responsibility under the law.
