The law takes effect six months after enactment. If injured in a motor vehicle crash, you can cancel a release of injury claims signed within 30 days of injury. You must have acted without a lawyer’s help or advice. You also must have had no power of attorney or employment contract with a lawyer to recover crash damages. You have 15 days after signing to cancel. Without a signed release, the 15 days starts when you cash a settlement check or receive electronic settlement funds. You must send written notice and return any check or settlement money to the party released, its lawyer, or its insurer. Both must be sent no later than 10 days after the 15-day cancellation period ends. Releases signed within 30 days of the accident must clearly and separately state cancellation rights on the release or settlement check. If neither document exists, you must receive written notice.
The law takes effect six months after enactment. When a crash victim cancels or seeks to cancel a release, the insurer may hold back later settlement money. It may do so until it confirms that the earlier check or settlement money has been returned.
