Care residents get clearer ownership information

Delaware long-term care facilities must report anyone with at least 5% direct or indirect ownership or controlling interest. They must also identify controlling people behind entities or affiliates, except publicly traded or nonprofit corporations. Affiliates are people or entities linked through direct, indirect, or shared control. Facilities must update reports within 30 calendar days of a change, following state reporting standards. The state and facilities must post current owner information online; consultation brochures must direct prospective residents and families to it. During ownership-change filings, proposed owners must report licensed care facilities they or their affiliates owned, ran, or managed nationwide during the preceding year. This includes U.S. territories and Washington, D.C., and disciplinary actions from that year involving serious risks to residents’ health, safety, or welfare. Within 30 days after state approval of ownership-change paperwork, current owners must give each resident and applicable authorized representative the proposed owner’s name and that history. Within 30 days after the state issues a new license, new owners must confirm those details and give the transfer date. Transfer disclosure rules exclude deals with binding sale agreements signed, or licensing, ownership-change, or similar approval applications filed, before the law took effect.
