Care workers skip promotion-only background checks

Current workers at covered Delaware long-term care facilities and home-care agencies no longer need another background check just for a promotion. This applies to promotions with the same employer. Workers still face screening when the Department reasonably suspects an arrest for a crime that bars employment since they began working.

Care workers face shorter background report validity

Delaware Background Check Center reports now stay valid for 1 year from the worker’s last fingerprinting, down from 3 years. Workers can use that report with any prospective employer covered by these rules during that year. The rules cover long-term care facilities and covered home-care work, including self-employed workers serving people in private homes. Employers must obtain a criminal history before employing an applicant. For workers not hired directly, the history must reach the facility or service recipient when work starts. Service recipients or their authorized representatives can also request the history. Former workers can consent to continued background reviews for a fixed period. The law removes the Department’s authority to set fingerprint frequency. The Department must set rules for employment suitability, report contents and updates, results notices, applicant access, and challenges to adverse information.
