4 provisions identified: 1 benefits, 1 costs, 2 mixed.
Beginning October 1, 2025, people harmed by qualifying altered sexual images made or maliciously promoted without consent can sue. Available damages are $10,000 or actual damages, whichever is greater. Courts can also order the conduct stopped and award reasonable attorney fees and court costs.
Beginning October 1, 2025, Florida assigns specified crimes to Levels 2 and 3 in its sentencing chart. Soliciting an altered sexual image without consent is Level 2. Generating, maliciously promoting, or possessing one with intent to maliciously promote it is Level 3. The new lewd-image solicitation, possession, control, and intentional-viewing offense is also Level 3. The revised chart also covers listed property, fraud, environmental, driving, boating, insurance, computer, drug, and public-safety crimes. These rankings guide sentencing calculations after conviction; they are not fixed prison terms.
Beginning October 1, 2025, Florida expands protections against altered sexual images of identifiable people made or sought without consent. Willfully creating such an image is a third-degree felony; a disclaimer saying the person did not participate is no defense. Soliciting one is also a third-degree felony when the requester knows or reasonably should know it was altered. The law also covers possessing one with intent to maliciously promote it, extending the existing third-degree felony for malicious promotion. That offense requires lack of consent and knowledge, or reasonable grounds to know, that the image was altered.
Beginning October 1, 2025, Florida adds criminal protections against real or altered images showing prohibited lewd exhibitions involving children. Altered images include exhibitions portrayed as occurring before an identifiable child under 16; proof of the child's actual identity is unnecessary. Possessing covered images to promote them is a second-degree felony; three or more copies count as evidence of that intent. Knowingly soliciting, possessing, controlling, or intentionally viewing covered lewd images is a third-degree felony. Knowingly soliciting child pornography is also a third-degree felony; each presentation and each child depicted support separate charges under these prohibitions. The solicitation, possession, control, and viewing prohibitions exclude material handled as part of a law enforcement investigation. Courts can consider an image's full content, the child's age, genital focus, setting, pose, clothing, sexual cues, and intended sexual response. Charges under the new lewd-image law do not prevent prosecution under other Florida laws.
