Clearer Rules and Deadlines for Development

Florida counties and municipalities must list required information for zoning, rezoning, subdivision, certification, special exception, and variance applications. They must share the list where applications are received, at preapplication meetings, or online. They must confirm receipt of development applications within 5 business days and review completeness within 30 days, identifying missing information. After an application is complete, final action is due within 120 days without a required hearing, or 180 days with one. The clock restarts only after an applicant-initiated change of at least 15% in proposed density, intensity, or parcel square footage. Applicants and local governments can agree to extensions; the deadlines exclude designated areas of critical state concern. Building permits are excluded. The municipal requirements begin October 1, 2025.

Fee Refunds for Delayed Development Reviews

Florida counties and municipalities must refund development application fees when they miss specified deadlines. A 10% refund applies for missing the initial 30-day completeness deadline or the 30-day review after the first additional-information submission. Missing the 10-day review after the second additional-information submission requires a 20% refund. Final action up to 30 days past the applicable 120- or 180-day deadline requires a 50% refund. At least 31 days late requires a 100% refund. No refund is required for agreed extensions, applicant-caused delays, or delays caused by force majeure or another extraordinary event. The municipal refund requirements begin October 1, 2025.

Firm Deadlines for Local Land-Use Plans

Florida local governments must send adopted comprehensive plan amendments within 10 working days after adoption following the first public hearing. If amendments are not adopted at the second hearing, formal adoption must occur within 180 days after that hearing. Otherwise, the amendments are deemed withdrawn. After the final adoption hearing, governments have 30 working days to send the amendments and supporting materials. Missing that deadline also means withdrawal.

Limits on School-Related Development Fees

Florida school districts cannot replace impact fees with alternative development fees unless those fees meet the law's requirements. These limits apply to fees charged for development's effects on school facilities. In court challenges, districts must prove that both the fee and its amount follow state legal precedent. The standard is a preponderance of the evidence, meaning more likely than not.
