New criminal penalties for gift card fraud

Beginning October 1, 2025, Florida law makes it a crime to take or keep a gift card or its access information without consent, tamper with a card or its packaging, get card information through false claims, or use unlawfully obtained cards to get something of value. A violation is a first-degree misdemeanor. It becomes a third-degree felony for a repeat offense or when the value exceeds $750; values may be added together. Value can include a card’s full amount even before activation.
