Patients gain a 30-day refund right

Starting January 1, 2026, covered Florida health care facilities and practitioners must refund patient overpayments within 30 days after determining an overpayment was made. The rules cover facility licensees that file reimbursement claims with government health programs, private insurers, or health maintenance organizations, and practitioners and specified billing or payment entities that accept payment for practitioner services. The refund rules exclude overpayments subject to sections 627.6131 or 641.3155. A facility licensee can face a fine of up to $500 per violation, and a practitioner can face professional discipline.
