Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Angervil and J.R. receive injury compensation

Effective upon becoming law, the law requires a one-time $3.1 million payment to Darline Angervil for injuries and damages. It also requires $3 million for an irrevocable trust, which cannot be revoked, solely for J.R.’s use and benefit. The South Broward Hospital District must use money not already committed to other uses. Attorney fees for this claim cannot exceed 25% of the $6.1 million award, or $1.525 million.

Angervil and J.R. face compensation limits

The law makes the settlement the only compensation for Angervil’s and J.R.’s present and future claims from the described medical events. This limit covers the District’s $300,000 prior payment under Florida law and the $6.1 million awarded by this law. Together, those amounts total $6.4 million; no additional compensation is available for those claims.
